General Terms and Conditions of Sale
The present general conditions of sale are applicable to all sales concluded between our company SAS Maison Wessman (hereinafter the “Seller”) and any Buyer (hereinafter the “Customer”), whether via the marketing space reserved for him on the website www.maisonwessman-wines.com or via collection at his physical boutique located at MW – Les Verdots- 24560 CONNE DE LABARDE.
In the absence of specific written stipulations between the parties, all orders are automatically subject to the present terms and conditions of sale, which prevail over any other document, such as prospectuses, catalogs or e-mailings issued by the seller, which are for information purposes only.
Article 1- Formation of the sale
The Vendor’s prices alone do not constitute an offer, and the Vendor reserves the right to refuse an order.
Products are offered while stocks last.
In the event of unavailability of products for which the order has been accepted, the Vendor may offer the Buyer a product of equivalent quality and price.
If the customer refuses, the Vendor will refund the sums paid within a maximum of thirty days.
The purchaser will not be entitled to any compensation in the event of unavailability of the products, regardless of the date on which he/she was informed of this.
Any request to modify an order must be made in writing. In the event of acceptance of the order modification, our company will be released from the deadlines.

Article 2 – Prices
The selling price of products and services is that in force on the day the order is placed: it is expressed in Euros (€) and displayed inclusive of all taxes.
This price does not include packaging and transport costs, which are invoiced in addition where applicable, and are subject to an estimate accepted by the Customer.
All taxes, excise duties or other charges are to be borne by the Buyer.
An invoice in Euros, including VAT, will be issued by the Vendor and given to the Customer at the time of collection of the products or completion of the service (in the case of tasting).
Article 3- Payment
Payments on the site’s sales area are made by credit card.
In-store payments are accepted by credit card, bank transfer (where applicable, the transfer must be made on receipt of the transfer order with the invoice, and will trigger the availability of the goods), cheque and cash.
No discount will be granted for early payment.
Payment for wines purchased in the boutique must be made at the latest when the wine is made available, and for wines purchased in the reserved area, when the order is validated.
In the event of failure to meet these deadlines, all sums due will become immediately payable, and the Seller will be entitled to demand payment of default interest at the legal rate after formal notice, and without prejudice to the company’s right to take any legal action necessary to recover its debt.
Recovery by legal action will give rise to a fixed indemnity amounting to 15% of the amount of the order, without prejudice to late payment interest and damages.
In addition, any deposit paid by the Buyer shall remain the Seller’s property.
Article 4 – Orders
The customer places an order on the https://www.maisonwessman-wines.com website. To purchase one or more items, the customer must follow the following ordering process:
– Select items and add to basket
– Confirm basket contents
– Identification on the website and registration on the identification form, on which he/she will enter all the contact details requested
– Choice of payment method and acceptance of the GTC
– Confirmation of payment
The customer will receive an order confirmation e-mail.
At any time during the order process, the customer can view the details of his order and its total price, and correct any errors, before confirming it to express his acceptance.
Maison Wessman reserves ownership of the items until full payment of the order, i.e. receipt of the order price by SAS Maison Wessman.
Maison Wessman reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning the payment of a previous order, or from a customer who does not have the capacity to contract.
Any order implies acceptance of the prices and descriptions of the items available for sale.
Maison Wessman undertakes to honour orders received on the website only while stocks last.
Geographical area
The online sale of items presented in the site is reserved for buyers residing in metropolitan France, Germany, Austria, Belgium, Denmark, Spain, Ireland, Northern Ireland, Italy, Luxembourg, Netherlands, Portugal, Bulgaria, Croatia, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia, Slovenia, Sweden, Czech Republic.
Store pickup
If the Vendor offers in-store collection, the products ordered are made available to the Customer directly at the Vendor’s collection point on the day, date and time chosen by the Customer, according to the time slots offered by the Vendor.
The Customer undertakes to collect the goods on the day, date and time chosen at the time of order validation.
The Customer must present himself at the location reserved for this purpose with the order summary, sent by e-mail to the address provided at the time of registration.
The Customer agrees to provide proof of his/her identity by means of one or more valid official documents and, if necessary, by communicating the number assigned by the system to his/her order and communicated to him/her in the e-mail confirming receipt of the order.
If the Customer is unable to accept the order himself, he must appoint a third party to represent him, who must be in possession of a power of attorney and a photocopy of the Customer’s identity card.
No request for delivery of the parcel can be honored if the conditions indicated above are not respected by the Customer.
Upon receipt of the products, the Customer must ensure that the order is correct.
Once the order has been collected, the customer cannot claim that a product is missing or damaged (apparent defect).
If the customer does not show up at the agreed date and time, the order will be held for 48 hours before being definitively cancelled, and the sums actually paid will be reimbursed.
Shipping and delivery times
Maison Wessman undertakes to deliver orders placed by the Customer within the agreed delivery times.
If the said items have not been delivered within 7 days of the delivery date specified in the order, and if this delay is not due to force majeure, the Customer may cancel the sale by sending a registered letter with acknowledgement of receipt to the following address: SAS Maison Wessman – Le Château 24560 Saint-Cernin de Labarde. The sums paid by the Customer will then be reimbursed in full.
Indicative delivery times for French customers are as follows: 2 to 5 working days
The customer has a period of 30 working days from the date of dispatch of the order to report non-receipt and request cancellation of the sale and reimbursement of the articles.
After this period, no cancellation of the sale will be accepted.
The customer is obliged to check the good condition of the items delivered.
Any anomaly noted (missing item, damaged package, broken item, etc.) must be reported to Maison Wessman within 3 days of receipt.
Article 5- Right of withdrawal for consumers in the case of distance selling
Customers have 14 clear days from receipt of their order to exercise their right of withdrawal.
The customer must first inform the sales department in writing (e-mail, fax, letter) of his decision before returning the goods (a form is available below* to download in pdf format).
As an exception, these provisions do not apply to orders for products that have been customized or specifically requested by the customer at the time of ordering (special formats, customized packaging, etc.).
If the products ordered are out of stock, VIGNOBLE DES VERDOTS may, with the customer’s agreement, offer to replace them with another vintage or an equivalent wine.
Once the retraction has been transmitted, a new period of 14 days is attributed́ to the customer to return the unwanted products in their original packaging, for exchange or refund, without penalty, with the exception of products ordered, the VIGNOBLE DES VERDOTS may offer the customer to replace them, with his agreement, either by another vintage, or by an equivalent wine.
Once the retraction has been transmitted, a further 14 days is allotted́ for the customer to return the unwanted products in their original packaging, for exchange or reimbursement, without penalty, with the exception of return costs (a flat-rate of 17 euros plus VAT, plus an average of 2.37 euros plus VAT per bottle for mainland France).
5.1 Right of withdrawal
Article L. 221-18 of the French Consumer Code states that consumers have a period of fourteen (14) days to exercise their right to withdraw from a distance contract, without having to give reasons for their decision.
The Customer must notify the Vendor (SAS Maison Wessman – Le Château 24560 Saint-Cernin de Labarde) of his decision to withdraw by sending, before the expiry of the aforementioned period, an unambiguous declaration expressing his wish to withdraw.
The period for exercising the right of withdrawal expires fourteen (14) days after the day on which the Customer, or a third party designated by the Customer, takes physical possession of the products.
5.2 Product return conditions
The Customer must first inform the Vendor in writing (e-mail, fax, letter) of his decision before returning the products.
Once the Customer’s request has been taken into account, the Customer must return the product(s) to the Vendor, without undue delay and, in any event, no later than fourteen (14) days following the date of communication of the Customer’s decision to withdraw.
This deadline is deemed to have been met if the Customer returns the product(s) before the expiry of the fourteen (14) day period.
The product(s) must be returned in their original packaging and in good condition, together with any accessories and documentation.
The product(s) must be in perfect condition for resale.
In other words, any product that is incomplete or damaged by the Customer as a result of handling other than that necessary to establish its nature, characteristics and proper functioning will not be reimbursed.
The Customer must go to the Seller’s point of collection where he/she has withdrawń his/her order with the product(s) concerned and the purchase invoice. He/she may also be asked to present the bank card used for payment.
5.3 Repayment
Should the Customer exercise his right of withdrawal, the Vendor is obliged to reimburse all sums paid by the Customer no later than fourteen (14) days from the date on which he is informed of the Customer’s decision to withdraw.
Nevertheless, the Vendor may defer reimbursement until the products have been recovered.
It is specified that a product that has benefited from a promotional advantage will be reimbursed at the price actually paid by the Customer or that should have been paid if it no longer meets the conditions for benefiting from it.
The Customer acknowledges and accepts that he/she will bear the full cost of returning the goods if he/she exercises his/her right of withdrawal.
Article 6- Legal warranties
We draw your attention to the fact that:
– the customer has a period of 2 years from delivery of the goods to act without having to prove the existence of the lack of conformity;
– in the event of lack of conformity, SAS Maison WESSMAN will replace, in accordance with Article L.211-9 of the French Consumer Code, the product with the same or an equivalent product.
The replacement will be made within a maximum of 1 month from receipt of the product returned by the Customer, and after tasting by our teams confirming the alleged defect;
– the legal warranty of conformity applies independently of any commercial warranty granted to the Customer;
– in the event of hidden defects or faults in the product, the customer may decide to invoke the warranty provided for in article 1641 of the French Civil Code, in which case he may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.
Article 7 – Transfer of ownership and risks
It is agreed that the products delivered and invoiced to the Customer will remain the property of the Vendor until full payment has been received.
Failure to pay may result in the Vendor reclaiming the products.
The above provisions do not preclude the transfer to the Customer of the risks of loss or deterioration of the products, or of any damage they may cause, from the date of delivery.
Article 8 – Privacy policy
The purpose of this personal data protection policy (hereinafter the ” Privacy Policy”) is to: (i) to govern the use that is made of personal data concerning you (hereinafter “Personal Data”) and ; (ii) to inform You about the processing that we carry out on your Personal Data on the occasion of your consultation and use of the Site Personal Data Regulations (European Regulation No. 2016-679 of April 27 2016 known as “RGPD” and Loi° 78-17 of January 6 1978 relative à l’informatique, aux fichiers et aux libertés modifiée).
www.maisonwessman-wines.com, in accordance with the regulations in force and the articles mentioned in these General Terms and Conditions of Sale, undertakes to respect and protect the confidentiality of your personal data, ensuring that the processing thereof is carried out in compliance with the provisions of the General Data Protection Regulation (GDPR – European Regulation No. 2016-679 of April 27, 2016) and the French Data Protection Act No. 78-17 of January 6, 1978 as amended.

Article 12- Disputes
These terms and conditions of sale are governed by French law.
The invalidity of any provision of these terms and conditions shall not affect the validity of or compliance with these terms and conditions.
In the event of difficulties in applying these general terms and conditions of sale, we invite you to seek an amicable solution by first contacting our Customer Service Department.
In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes, if you have sent a written complaint to the professional and have not obtained satisfaction or a response within two months, you may submit your complaint free of charge to the consumer ombudsman, within a maximum period of one year from the initial complaint.
In the event of persistent disagreement concerning these conditions and in the absence of amicable agreement, any dispute will be referred to the competent court of the seller’s registered office.
